Purpose of the Bill : This bill creates a Selling Stolen Property charge, which is used when a person receives stolen property and then sells it to another person. It is a class A misdemeanor unless the value of the property sold is $1,000 or more, or unless the seller has been convicted two or more times of Selling Stolen Property, in which cases it is a class G felony.
A class A misdemeanor is punishable by a fine of up to $2,300 or a term of imprisonment of up to 1 year, or both, and any fines, costs, or conditions that the Court orders. A class G felony is punishable by a term of imprisonment of up to 2 years and such other fines and penalties as the court considers appropriate.
Committee Findings: Julie Miro Wenger of the Delaware Food Industry Council spoke for the bill and explained that they worked with the Delaware State Police in order to give them another tool to charge people with both receiving and selling stolen property. Chris DiPetro of EBay also supported the bill. The committee had some concerns that this adds another felony which could result in more beds needed in the Correctional facilities which there is no money to fund.
