Purpose of the Bill : It is well-settled that a person may be found guilty of burglary if he or she forms the intent to commit a crime in a building prior to or concurrently with his or her unlawful entry therein. This Act clarifies that a person may also be found guilty of burglary if he or she enters a building unlawfully and thereafter remains in the building after forming the intent to commit a crime therein.


Committee Findings: Paul Wallace of the Attorney General’s Office explained what the charges and punishment would be under current law and how they differ in this law. The committee supported the bill without questions.
