Purpose of the Bill : This Bill will clarify that a Constable’s verification of services process need not be in affidavit form in order for the Court to enter a default judgment. This is permissible because Constables are employees and officers of the Court and there are administrative means to ensure that the Constable has performed his or her duty. The original provision finds its roots in a time when Constables were independent officers, not under the direct authority of the Court.
