Purpose of the Bill : This act enables an agent, surrogate or guardian of the person to have full authority and standing under the Health Insurance Portability and Accountability Act ("HIPPA"), its regulations and standards, to act as the personal representative under HIPPA, even if the advance healthcare directive, surrogate confirmation or guardianship order does not so expressly provide. This would help the agent, surrogate or guardian of the person make healthcare decisions on behalf of the incapacitated declarant or disabled person.
