| Long Title: | AN ACT TO AMEND TITLE 7 OF THE DELAWARE CODE RELATING TO TAX DITCHES. |
| Synopsis: | This Bill terminates tax ditch construction easements that may be up to 250’ or wider on each side of a tax ditch, once the tax ditch has been constructed. This Bill authorizes an expedited process for the Division of Soil and Water Conservation to modify tax ditch maintenance easements or rights-of-way when permanent structures and accessories have been allowed or approved to be built within the easement or right-of-way. This Bill recognizes the rights of property owners to protect their lands and improvements from previously unrecorded easements or rights-of-way. This Bill also clarifies that once a tax ditch has been dissolved, all easements and rights-of-way granted in connection with the tax ditch also dissolve.
