Long Title:AN ACT TO AMEND TITLE 10 OF THE DELAWARE CODE RELATING TO VERIFICATIONS OF SERVICE OF PROCESS.
Synopsis:This act will clarify that a Constable’s verification of service of process need not be in affidavit form in order for the Court to enter a default judgment. It retains the obligation of special process servers to file an affidavit of service with their return of service or process. This difference is permissible since Constables are employees and officers of the Court and there are administrative means to ensure that the Constable has performed his or her duty. The original provision finds its roots in a time when Constables were independent officers, not under the direct authority of the Court.
