Long Title:AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO GRAFFITI AND POSSESSION OF GRAFFITI IMPLEMENTS.
Synopsis:This act increases the penalties for graffiti and possession of graffiti implements. Currently, graffiti and possession of a graffiti implements are punished by a fine, community service and restitution. This act makes graffiti a class A misdemeanor (or a Class G felony if the property damage exceeds $1500.00) and possession of graffiti implements a class B misdemeanor. These enhanced penalties are consistent with the penalties imposed for other crimes, such as criminal mischief, involving damage to the property of another. The requirements of a minimum fine, restitution for property damage and community service remain a part of the enhanced penalties.
