| Long Title: | AN ACT TO AMEND TITLE 10 OF THE DELAWARE CODE RELATING TO NUISANCE ABATEMENT. |
| Synopsis: | This Act updates the Nuisance and Social Vices Abatement Act by clarifying certain language, and specifying evidentiary standards and proofs applicable to the Superior Court proceedings. The Act also amends the current law by reflecting recent changes to the weight of certain controlled substances that are necessary to establish a trafficking offense under Title 16 of the Delaware Code.
Finally, the Act establishes the Attorney General’s Nuisance Abatement, which like the Consumer Protection Fund, will be used to fund in significant part the costs associated with the investigation and prosecution of these cases by the Department of Justice.
