SENATE SUBSTITUTE NO. 1

SENATE BILL NO. 27

AN ACT TO AMEND ARTICLE XV OF THE CONSTITUTION OF THE STATE OF DELAWARE RELATING TO MARRIAGE

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):

Section 1. Amend Article XV of the Constitution of the State of Delaware by adding thereto the following:

“Section 11. Only a marriage between one man and one woman shall be a valid or legally recognized marriage in this State.”

SYNOPSIS

This is the first leg of a Constitutional Amendment to affirm that marriage in Delaware shall be between one man and one woman. This Substitute Bill is consistent with current Delaware statutory law and may not preclude civil union law for future consideration.
