<br><br>	This Bill removes a provision by which either the Chief Justice of the Supreme Court or the Deputy Administrator for the Justice of the Peace Court was required to verify the final disposition of a case before a previously paid fine could be refunded.  This Bill changes the practice in the Justice of the Peace Court to mirror that of the Court of Common Pleas, allowing the court clerk, subject to the internal controls now in place in the Court, to verify the final disposition of a case when a fine should be refunded.

Furthermore, our legal system is increasingly placing children in much the same role as adults when it comes to trying and sentencing those children.  This Act establishes a procedure for the evaluation of the competency of a child for the purpose of Family Court proceedings.    

	A child&#8217;s competency may be raised by either party or by the Court itself.  If the Court determines that there are facts that support the completion of a competency evaluation, the prosecution is stayed and the Court shall order that such an evaluation be performed by a competency evaluator. 
 
	The evaluation must address certain factors, including the child&#8217;s ability to assist counsel in the child&#8217;s defense and the child&#8217;s ability to understand the nature of the proceedings.  The evaluation must recommend appropriate treatment or services and must specify any conditions that will not result in restoration of competency even with treatment.

	If the Court rules that a child is competent, the prosecution of the case shall resume.  If the Court rules that the child is not competent, the Court shall make a finding on whether competency can be restored and, if competency can be restored, order appropriate treatment or services based on the recommendations in the evaluation.  The underlying bases for a finding that a child is not competent may include significant mental illness, significant developmental disabilities, significant cognitive impairments, or chronological immaturity.  If the child is found to be not competent, the Court has various remedies at its disposal, including dismissal of certain charges after certain periods of time.

	Finally, any finding by the Court regarding the competency of a child is limited to the specific proceedings at issue when competency is raised.

First, it applies the existing expungement rules to violations of county and municipal codes, ordinances, and regulations.  By doing so, expungements of such violations will be simplified and require less Superior Court resources.  Second, it applies the existing rules for the First Offenders Controlled Substance Diversion Program to court-supervised drug diversion programs, which is the means by which most minor drug offenders are diverted.  Third, it provides for expungement of first offense elections under § 4177B of Title 21, which provides for probation before judgment for qualifying first-time DUI offenders.

In addition, the Bill provides for a military spouse to apply for a six-month temporary license or permit while the application for endorsement or reciprocity is being processed to verify good standing and to perform the criminal background check.

The Task Force shall study the transitional needs of children and youth with disabilities and special health care needs and develop strategies to ensure successful transition from children and adolescent services into adult services.  The Task Force shall present a final report of its findings and recommendations to the Governor and the General Assembly within one year of the passage of this Resolution.

All the members of the first American cabinet had Scottish ancestry. Delaware&#8217;s first governor &#8211; John McKinly, was born in Northern Ireland of Scottish descent. Americans of Scottish descent have played a vibrant and influential role in the development of this country. However, not until 1997 was this influence recognized by a single-year U.S. Senate Resolution that appeared in the Congressional Record of April 7, 1997. In 1998 National Tartan Day was officially recognized on a permanent basis when the U.S. Senate passed Senate Resolution 155 recognizing April 6th as National Tartan Day. This was followed by companion bill House Resolution 41 which was passed by the U.S. House of Representatives on March 9, 2005. President George W. Bush signed a Presidential Proclamation on April 4, 2008 making April 6 National Tartan Day. In April of 2008, then Governor Minner issued a statement celebrating the accomplishments of Scots-Irish Americans in the First State as part of a Scots/Scots-Irish Heritage Month.
 	April 6 commemorates the signing of the Declaration of Arbroath in 1320, which asserted Scotland's sovereignty over English territorial claims, and which was a significant influence on the American Declaration of Independence. 
 	Canada has been celebrating "National Tartan Day" since 1993. The idea and motivation for creating a similar American holiday was provided by the Scottish Coalition, a group of national Scottish- American cultural organizations.
