AN ACT TO AMEND TITLE 18 OF THE DELAWARE CODE RELATING TO SUPPLEMENTAL COVERAGE FOR CHILDREN OF INSUREDS. 

 


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

 


Section 1.  Amend § 3354, Title 18 of the Delaware Code by striking the existing language in current subsection (a)(3)a. and substituting in place thereof:  “Is less than 26 years of age;”; deleting “c.”, redesignating “d.” and “e.” as  “c.” and “d.”, respectively; and striking “twenty-fourth” where it appears in § 3354(b) and inserting “twenty-sixth” in its place.

Section 2.  Amend § 3570, Title 18 of the Delaware Code by striking the existing language in current subsection (a)(3)a. and substituting in place thereof: “Is less than 26 years of age;”, deleting “c.”, redesignating “d.” and “e.” as “c.” and “d.” respectively; and striking “twenty-fourth” where it appears in § 3570(b) and inserting “twenty-sixth” in its place.

Section 3.  The provisions of this Act shall be of no force or effect if “The Patient Protection and Affordable Care Act”, Public Law 111-148, is declared unconstitutional by the Supreme Court of the United States of America.


SYNOPSIS

                This Act changes provisions for supplemental health insurance coverage for children of insureds, raising the age children may be covered by their parent’s or parents’ health insurance to the age of 26.  The provisions of this Act shall have no force or effect if the health care bill passed by Congress and signed by the President of the United States in 2010 is declared unconstitutional by the Supreme Court of the United States of America.
