HOUSE AMENDMENT NO. 1

TO

HOUSE BILL NO. 453

AMEND House Bill No. 453 by inserting between line 15 and line 16 the following:

e. The pumping system would not connect to a treatment system used to convey wastewater, fertilizers, chemicals, or provide fire protection.

f. The water system would not draw from more than one aquifer without a backflow prevention device on the discharge line of each well. ”.

FURTHER AMEND House Bill No. 453 on line 20 by deleting “ preventors. ” and inserting in lieu thereof: “ preventers. ”.

FURTHER AMEND House Bill No. 453 by deleting lines 21 through 27 in their entirety and inserting in lieu thereof the following:

(d) Notwithstanding subsection (c) of this section, if any of the buildings named in subsection (c) of this section have fresh water supplied by a public well, backflow preventers must still be installed in compliance with state well construction regulations. ”.

SYNOPSIS

House Bill No. 453 protects Delaware’s fresh water supply while also reducing costs for small businesses and single-family residential homeowners by eliminating certain requirements relating to the installation of backflow prevention devices.

This Amendment makes corrections to align with the Department of Natural Resources and Environmental Control’s Well Construction Regulation: 7301, Regulations Governing the Construction and Use of Wells. This Amendment also corrects the spelling of the word “preventers” on line 20.
