HOUSE AMENDMENT NO. 1

TO

HOUSE BILL NO. 476

AMEND House Bill No. 476 on line 8 by deleting “ social ” and inserting in lieu thereof “ law enforcement ”.

FURTHER AMEND House Bill No. 476 on line 8 by deleting “ and all ”, as it appears therein, and inserting in lieu thereof: “ platforms, including social media platforms, and law enforcement ”.

FURTHER AMEND House Bill No. 476 on line 9 by inserting after “ located. ” the following :

Once the data is electronically removed the law enforcement agency must follow retention and disposition requirements under Chapter 5 of Title 29. ”.

SYNOPSIS

This amendment clarifies that once the missing person is located law enforcement agencies must remove the notifications within 72 hours from law enforcement social media platforms and websites. It also requires the law enforcement agency, in regard to the electronic notifications, follow records retention and disposition requirements under Chapter 5 of Title 9.
