HOUSE BILL NO. 112

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO LICENSES AND PERMITS ISSUED TO SERVICE MEMBERS AND THEIR SPOUSES BY BOARDS AND COMMISSIONS ADMINISTERED BY THE DIVISION OF PROFESSIONAL REGULATION.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 8735, Title 29 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 8735. Division of Professional Regulation.

(p) Continuation and issuance of licenses and permits for deployed active duty, activated Reserve and National Guard military personnel . —

(7) As used in this section section, “qualifying person” means an individual who is a member of the active duty military, a member of the National Guard or Guard, a member of the military reserve , retired military, or a military veteran who is reassigned to a duty station in this State or deployed by the President of the United States or the Governor of this State .

SYNOPSIS

This Act allows professional licensing boards and commissions administered by the Division of Professional Regulation to recognize military education, training, and experience of all current and former military personnel when reviewing credentials and issuing licenses. This is a change from the current law, which only allows such boards and commissions to do so for active duty military, members of the National Guard, or military reserves assigned to a duty station in Delaware. This change would recognize the military education, training, and experience of individuals who are retired, a veteran, or are active duty individuals assigned to duty stations located outside this State.
