AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO DONATED LEAVE.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 5956(a), Title 29 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 5956 Donated leave program.

(a) An officer or employee of this State, with the approval of his or her immediate supervisor or the Director of the Division in which he or she is employed, may donate accrued sick leave and annual leave in equal amounts to a Leave Bank established by the Director of the Office of Management and Budget for all officers or employees of this State or to another officer or employee of this State. The amount of sick leave and annual leave do not need to be in equal amounts. Additionally, an officer or employee of the State may donate either sick leave or annual leave and does not have to donate both.

SYNOPSIS

This bill allows for the donation of either sick leave or annual leave without having to do so in equal amounts. Additionally, a person can donate sick leave or annual leave but does not have to donate both.
