SENATE BILL NO. 131

AN ACT TO AMEND TITLE 24 OF THE DELAWARE CODE RELATING TO REGULATORY REVIEW OF BOARDS AND COMMISSIONS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend Title 24 of the Delaware Code by making deletions as shown by strikethrough and insertions as shown by underline as follows:

Chapter 56. Regulatory Review of Boards and Commissions.

§ 5601. Regulatory Review of Boards and Commissions.

If a profession or occupation becomes regulated or a board or commission is created [after the effective date of this Act] and is authorized to promulgate rules and regulations regarding the profession or occupation, the board or commission promulgating rules and regulations must, after the initial adoption of rules and regulations establishing requirements pertaining to the licensure, maintenance, or standards of the profession or occupation, submit the initially adopted rules and regulations to the Joint Legislative Oversight and Sunset Committee. The board or commission must submit the initially adopted rules and regulations to the Joint Legislative Oversight and Sunset Committee as soon as practicable after the initial adoption. The Joint Legislative Oversight and Sunset Committee shall conduct a review of the initially adopted rules and regulations under § 10212 of Title 29 and make recommendations regarding the rules and regulations in accordance with the procedures under § 10212 of Title 29.

SYNOPSIS

This Act requires that a board or commission created after the effective date of this Act submit the initial adopted rules and regulations pertaining to the licensure, maintenance, and standards of the board or commission to the Joint Legislative Oversight and Sunset Committee, shall review the rules and regulations and make recommendations in accordance with § 10212 of Title 29.
