HOUSE BILL NO. 347

AN ACT TO AMEND TITLE 31 OF THE DELAWARE CODE RELATING TO THE PROVIDER ADVISORY BOARD.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 347, Title 31 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 347. Provider Advisory Board; powers and duties.

The Board shall have the authority to serve in an advisory capacity to the Office of Child Care Licensing with regard to adopting, promulgating and amending such rule and regulations as has the following powers and duties:

(1) Advise and consult with the Secretary and OCCL regarding the development, adoption, promulgation, and any amendment to the rules, regulations, and policies that are required to carry out this chapter with respect to early care and education education, family child care homes, and school-age centers.

(2) Encourage the Secretary and OCCL to communicate with persons licensed under this chapter and to facilitate such communication.

(3) Encourage the Secretary and OCCL to enforce this chapter in a manner that recognizes that most child care providers are private businesses that need stable and reasonable regulations.

SYNOPSIS

This Act strengthens the role and responsibilities of the Provider Advisory Board in regard to the implementation and enforcement of The Delaware Child Care Act.
