HOUSE BILL NO. 370

AN ACT TO AMEND TITLE 19 OF THE DELAWARE CODE RELATING TO EMPLOYMENT PRACTICES.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 745 of Title 19 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 745 Establishment of Employment First Oversight Commission.

(b) The Commission shall consist of 11 13 members, who are residents of this State , or work in the State of Delaware and whose employment agency shall either represent or advocate for the employment of persons with disabilities .

(1) Four members who are persons with a disability and who are knowledgeable of disability issues and who are not state employees whom shall be recommended by the Commission , 1 of whom shall be a veteran and 1 of whom shall be a member of the State Council for Persons with Disabilities, and of whom:

(9) the Secretary of the Department of Human Resources or a designee appointed by the Secretary;

(10) the Executive Director of the Delaware Community Legal Aid Society Inc. or a designee appointed by the Executive Director.

SYNOPSIS

This Bill adds the Secretary of the Department of Human Resources and the Executive Director of Delaware CLASI or their designees to the Employment First Oversight Commission (hereinafter “EFOC”). The Bill also allows non-Delaware residents who work in Delaware for an employment agency that advocates or represents disabled individuals to participate on the EFOC. Finally, the Bill eliminates the prohibition on appointment of state employees to the EFOC under § 745 (1).
