HOUSE BILL NO. 430

AN ACT TO AMEND TITLE 3 OF THE DELAWARE CODE RELATING TO AGRICULTURE.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend Section 101, Title 3 of the Delaware Code by making deletions as shown by strike through insertions as shown by underline and as follows:

§ 101 Powers.

The Department of Agriculture may:

(6) Collect samples of foods, dairy and other feeds, and insecticides and have them analyzed by a laboratory designated by the Department of Agriculture the State Chemist , and cooperate with the United States Department of Agriculture and other federal agencies in enforcing the laws on these subjects as prescribed by the Congress of the United States;

Section 2. This act shall be effective upon enactment.

SYNOPSIS

This Bill authorizes the Department of Agriculture to utilize any laboratory designated by the Department of Agriculture rather than only the State Chemist to analyze samples of foods, dairy and other feeds and insecticides, and to cooperate with the United States Department of Agriculture and other federal agencies in the enforcement of the laws related to foods, dairy and other feeds, and insecticides.
