HOUSE BILL NO. 466
AN ACT TO AMEND TITLE 25 OF THE DELAWARE CODE RELATING TO A MANUFACTURED HOUSING RENT INCREASE.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend § 7021, Title 25 of the Delaware Code by making deletions as shown by strikethrough and insertions as shown by underline as follows:
§ 7021. Rent increases.
A landlord may not increase a tenant's lot rent more than once during any 12-month period, regardless of the term of the tenancy or the term of the rental agreement. A landlord shall give written notice of a lot rent increase to a tenant a minimum of 60 90 days prior to the effective date of the rent increase.
SYNOPSIS
This Act makes a technical correction to § 7021 of Title 25 so that it is consistent with § 7043 of Title 25. Section 7021 is the original rent increase section. It requires a landlord to provide a minimum 60 days notice of a rent increase and was not revised when § 7043, which requires a minimum of 90 days notice of a rent increase, was enacted in 2013.
