HOUSE AMENDMENT NO. 2

TO

HOUSE BILL NO. 19

AMEND House Bill No. 19 on line 11 by inserting “ or equal to ” between “ than ” and “ 750 watts ”.

FURTHER AMEND House Bill No. 19 on line 23 by deleting “motor” as it appears therein and inserting “ motor engine ” in lieu thereof.

FURTHER AMEND House Bill No. 19 by deleting lines 24 and 25 in their entirety and inserting in lieu thereof the following: “piston displacement is less than 55cc, or an electric motor rated between 751 watts and 2,000 watts that may be used exclusively to propel the bicycle at a speed of more than 20 miles per hour or, if the rider is pedaling, continues to provide assistance even when the bicycle reaches a speed of more than 28 miles per hour. “Moped” does not include an electric bicycle.

FURTHER AMEND House Bill No. 19 by deleting lines 80 and 81 in their entirety and redesignating accordingly.

FURTHER AMEND House Bill No. 19 on line 83 by deleting “ a class 1 or Class 2 electric ” and inserting in lieu thereof “ an ”.

FURTHER AMEND House Bill No. 19 by adding after line 87 and before line 88 the following:

(4) Sidewalks, including those permitted to be used by bicycles, while using the electric motor.

(5) Any trail or multi-use path that is specifically designated as nonmotorized, while using the electric motor.

SYNOPSIS

This Amendment clarifies the definition of “electric bicycle” by providing that an electric bicycle includes a bicycle with an electric motor equal to 750 watts. It also clarifies the definition of “moped”, and permits local authorities and state agencies having jurisdiction over a bicycle or multi-use path to prohibit the operation of any class of electric bicycle on the path if, after notice and hearing, the authority finds the restriction is necessary for safety reasons or for compliance with other laws or legal obligation. This amendment makes clear that an electric bicycle cannot be ridden while using the electric motor on any sidewalk, including a sidewalk permitted to be used by bicycles or any trail or multi-use path that is specifically designated as nonmotorized.
