HOUSE AMENDMENT NO. 1

TO

HOUSE BILL NO. 80

AMEND House Bill No. 80 by inserting after line 2 and before line 3 the following and redesignating accordingly:

Ҥ 5501. Definitions.

(k) “Specified peace officer” shall mean:

(1) Probation and parole officers and classifications in the Probation and Parole occupational series up to and including the Probation and Parole Director employed by the Department of Corrections;

(2) Capitol police officers;

(3) Department of Natural Resources police officers;

(4) University of Delaware Police;

(5) Delaware State University Police;

(6) State Fire Marshal officers;

(7) Division of Alcohol and Tobacco Enforcement agents and classifications in the Alcohol and Tobacco Enforcement Agents occupational series up to and including the Director of Alcohol and Tobacco Enforcement;

(8) Delaware State Police Drug Diversion Unit agents;

(8) Justice of the Peace Court constables; and

(9) Probation and parole officers in the Serious Juvenile Offender Unit and senior probation officers employed by the Division of Services for Children, Youth, and their Families.”

FURTHER AMEND House Bill No. 80 at line 5 by inserting " (1) " after "(a)" as it appears thereon.

FURTHER AMEND House Bill No. 80 at line 18 by striking " (1) " as it appears thereon and inserting in lieu thereof " (2) ".

FURTHER AMEND House Bill No. 80 on line 20 by deleting “ Until ” as it appears before “ December ” and inserting in lieu thereof the following: “ For years of service before ”.

FURTHER AMEND House Bill No. 80 on line 22 by deleting “ After ” as it appears before “ January ” and inserting in lieu thereof the following: “ For years of service on or after ”.

FURTHER AMEND House Bill No. 80 by inserting after line 26 and before line 27 the following:

“§ 5543. Employee contributions.”

FURTHER AMEND House Bill No. 80 on line 32 by deleting “in excess of $6,000” and inserting in lieu thereof “ in excess of $6,000 ”.

SYNOPSIS

This amendment changes House Bill 80 by clarifying the following: (1) The revised pension multiplier only applies to years of service on or after January 1, 2022; (2) That the employee contribution for a correction officer or specified peace officer is 7% of all annual compensation. This amendment also adds State Police Drug Diversion Unit agents, who are not Delaware State Police Troopers, to the definition of “specified peace officer”, and makes clear that Delaware State University police officers are also "specified peace officers".
