HOUSE AMENDMENT NO. 1
TO
HOUSE BILL NO. 290
AMEND House Bill No. 290 on line 19 by inserting after "closed" and before the period therein the following:
“ , which means a container that is designed to prevent consumption without removal of the lid, cap, or seal, and does not include a container with a lid with sipping holes or openings for straws ”.
FURTHER AMEND House Bill 290 by inserting after line 21 and before line 22 the following:
“ c. Be sold and served only by a person certified as a responsible alcoholic beverage server pursuant to § 1205 of this title. ”
SYNOPSIS
This bill clarifies that alcoholic beverages sold in transactions for take-out or curbside service must be in a container that is designed to prevent consumption without removal of the lid, cap or seal in order to avoid a consumption while driving. This bill also makes clear that only persons certified by the Division of Alcohol and Tobacco Enforcement as a responsible alcoholic beverage server can sell and serve alcoholic beverages in transactions for take-out or curbside service.
