AN ACT TO AMEND TITLE 4 OF THE DELAWARE CODE RELATING TO ALCOHOLIC LIQUORS.

 


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

 


Section 1. Amend § 101, Title 4 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 101. Definitions.

As used in this title, in addition to their usual meaning:

(36) “Restaurant” means any establishment which is regularly used and kept open principally for the purpose of serving complete means meals to persons for consideration and which has seating at tables for 35 12 or more persons and suitable kitchen facilities connected therewith for cooking an assortment of foods under the charge of a chef or cook.


SYNOPSIS

Section 1 of this Act amends the definition of “restaurant”, as it relates to Delaware’s laws governing the sale and consumption of alcoholic liquors, to allow smaller restaurants, those with seating for at least 12 individuals, to apply for a license to sell alcoholic liquors in connection with the sale of complete meals.

Section 1 of this Act also corrects an error made in a prior revision of the definition in which “complete meals” was changed to “complete means”.
