| Long Title: | AN ACT TO AMEND TITLE 25 OF THE DELAWARE CODE RELATING TO MANUFACTURED HOME COMMUNITIES. |
| Synopsis: | This bill establishes the right of first offer either directly, or indirectly through the DMHOA or the Delaware Manufactured Home Relocation Authority, for a manufactured home owner association upon the decision of a community owner to sell, transfer, or convey all or part of the community. A community owner may not sell to another at the price or less than the price offered by a home owner association. A home owner association's offer is valid for twelve months. The bill further establishes the right of a community owner to buy a home in the community for the same price accepted by a home owner who is ready to sell his or her home in the community.
The modified Table of Consanguinity on page 18 of this bill is used to determine a circumstance under which a community owner or a home owner is not required to give notice of a decision to sell, transfer, or convey a community or a home.
The bill also contains model bylaws to be used by home owner associations.
