HS 1 for HB 57CommitteeKowalkoIn an attempt to obey federal law, to coordinate with the federal law enforcement agencies, and to assist Delaware registered agents who form LLCs to avoid severe federal fines, this bill attempts to prevent the use of our Limited Liability Act by persons, businesses, groups and nations identified by federal agencies as a threat to this country. Listed entities on OFAC sanctions lists are narcotics traffickers, terrorists, or criminal enterprises with whom federal law forbids Americans from doing business. The means of meeting these objectives is by requiring screening of potential clients (applicants) by companies who are registered agents approved by this State to represent clients who form LLCs. No sanctions will be employed to obtain cooperation, unless the Secretary of State, who already has the authority to deal with registered agents, finds that they are not cooperating.AN ACT TO AMEND TITLE 6 OF THE DELAWARE CODE RELATING TO LIMITED LIABILITY COMPANIES.
SCR 46IntroducedEnnisThis Senate Concurrent Resolution urges the Congress of the United States to enact legislation that would reinstate the separation of commercial and investment banking functions that were in effect under the Glass-Steagall Act (Banking Act of 1933). Federal legislation based on the Glass-Steagall precedent is needed in order to prohibit commercial banks and bank holding companies from investing in stocks, underwriting securities, or investing in or acting as guarantors to derivative transactions, in order to prevent American taxpayers from being called upon to fund hundreds of billions of dollars to bail out financial institutions. REQUESTING THE CONGRESS OF THE UNITED STATES TO REINSTATE THE SEPARATION OF COMMERCIAL AND INVESTMENT BANKING FUNCTIONS PREVIOUSLY IN EFFECT UNDER THE GLASS-STEAGALL ACT AND SUPPORT EFFORTS TO RETURN TO NATIONAL BANKING POLICIES TO REPAIR OUR NATION'S INFRASTRUCTURE.

The purpose of this provision is to allow all interested persons, including legislators, a reasonable amount of time to review the three significant financial legislative acts before voting on such legislation. This change is necessary so that a person who needs to fish in the fishery conservation zone to reach an established State quota of fish can safely and efficiently land the fish in Delaware. This Act also makes a technical correction to conform existing law to the standards of the Delaware Legislative Drafting Manual.AN ACT TO AMEND TITLE 7 OF THE DELAWARE CODE RELATING TO TYPES OF FISHING EQUIPMENT AND METHODS USED FOR FISHING FOR FOOD FISH.
SA 2 to HB 300PassedDelcolloThis Amendment amends the language added by House Amendment No. 1 to House Amendment No. 1 to House Bill No. 300 to provide that relinquishment of a bump stock or trigger crank is not proof or possession. This change will allow people to continue to relinquish these weapons without fearing prosecution based solely on the fact that they had the weapon when it was relinquished.

Possession of a bump stock or trigger crank is a Class B misdemeanor for the first offense and a Class G felony for a second or subsequent offense. 2. Possession of a bump stock or trigger crank which has been attached to a firearm and used during the commission of a felony is a Class E felony. 3. Possession of a bump stock or trigger crank which has been attached to a firearm and used during the commission of a felony that was a crime of violence is a Class D felony.

Requires the Secretary of the Department of Safety and Homeland Security to establish the rules and regulations for this compensation program. 2. Provides for a monetary payment of $100.00 for each bump stock weapon and $15 for each trigger crank weapon relinquished under the compensation program. 3. Requires the compensation program will operate from July 1, 2018 through June 30, 2019. 4. Requires a report to the General Assembly on the results of the program. 5. Appropriates $30,000.00 for the compensation required under this program. The Amendment also provides that a person is not guilty of an offense under this Act if they are acting under this compensation program.  
SA 3 to HB 300DefeatedDelcolloThis Amendment creates an affirmative defense to the crime of possessing a destructive weapon if the person did not know that the weapon was a bump stock or trigger crank when the person sold, transferred, bought, received, or had possession of it.
