CHAPTER 267

EN ER A L PROVISIONS RESPECTING TRADE.

AN ACT TO PREVENT THE ADULTERATION OF CANDY.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met :

SECTION 1. (NO person or corporation shall, by himself or itself; or by his or its servants or agents, or as the servant or agent of any other person or corporation, manufacture for sale, or knowingly

sell, or offer to sell, any candy adulterated by the admixture of Terra Alba, Barytes, Tale, or any other mineral substance, by poisonous colors, or flavors, or other ingredients deleterious or detrimental

to health.

SECTION-2. Any person, company, firm, or corporate body who shall manufacture, sell, or offer, or expose for sale, or have in his, her or its possession, with intent to sell, any candy, the manufacture and sale of which is prohibited by First Section of this Act, shall be deemed guilty of a misdemeanor, and upon conviction, shall forfeit and pay a fine of not less than fifty dollars ($50) nor more than one hundred dollars,($100).

The candy so adulterated shall be forfeited and destroyed under the direction of the Attorney General.
