CHAPTER 111 - LEVY COURT - NEW CASTLE COUNTY BUILDING CODE

AN ACT TO AMEND "AN ACT TO REGULATE THE CONSTRUCTION, ALTERATION, REPAIR, REMOVAL, DEMOLITION, EQUIPMENT, USE AND OCCUPANCY, LOCATION AND MAINTENANCE OF BUILDINGS AND STRUCTURES IN THE COUNTY OF NEW CASTLE OUTSIDE OF THE CITY OF WILMINGTON FOR THE PROTECTION OF THE PUBLIC HEALTH AND SAFETY AND FOR THE PREVENTION OF FIRE HAZARDS; TO PROVIDE A CODE OF BUILDING REGULATIONS; TO CREATE THE OFFICE OF BUILDING INSPECTOR AND OTHER HELPERS AND ASSISTANTS AS MAY BE REQUIRED; AND TO PROVIDE PENALTIES FOR VIOLATIONS", BEING CHAPTER 84, VOLUME 44, LAWS OF DELAWARE, BY PROVIDING FOR CERTAIN EXEMPTIONS OF PERSONS AND CORPORATIONS THEREFROM.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. That Chapter 84, Volume 44 Laws of Delaware be and the same hereby is amended by striking out and repealing all of Section 17 thereof and inserting in lieu thereof a new Section to be known as Section 17 thereof, as follows:

Section 17. Exemptions:--The provisions of this Act shall not apply to structures necessary to the operation of farm lands nor to properties located within any incorporated City or Town in New Castle County nor to properties used for industrial purposes nor to individual owners of properties who desire to do their own work, as contemplated by this Act, in and about his own home occupied by such owner, and which is not for sale; provided, however, that such individual owner shall, before be-. ginning any such work, obtain a permit from the County officer or inspector having supervision of such work and otherwise comply with reasonable rules and regulations promulgated with respect to such work where the same is to be done by such individual owner, owning his own property.
