CHAPTER 254

LIMITATION OF ACTIONS

AN ACT RELATING TO THE LIMITATION OF ACTIONS WHERE THE CAUSE OF ACTION ARISES OUTSIDE OF THE STATE OF DELAWARE.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. Where a cause of action arises outside of this State, an action cannot be brought in a court of this State to enforce such cause of action after the expiration of whichever is shorter of the time limited by the law of this State, or the time limited by the law of the state or country where the cause of action arose, for bringing an action upon such cause of action, except that where the cause of action originally accrued in favor of a person who at the time of such accrual was a resident of this State, the time limited by the law of this State shall apply. This act shall be applicable as well to causes of action which have already arisen, but to enforce which action has not yet been brought, as to causes of action hereafter arising.

Section 2. This act shall take effect immediately upon becoming law.
