CHAPTER 119

MOTOR VEHICLES - PROVIDING INSURANCE COVERAGE FOR SCHOOL BUSSES

AN ACT TO AMEND CHAPTER 10 OF THE REVISED CODE OF DELAWARE, 1935, ENTITLED "MOTOR VEHICLES," AS AMENDED, IN REFERENCE TO REGULATION RELATIVE TO SCHOOL BUSSES BY PROVIDING FOR INSURANCE COVERAGE.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. That Chapter 165 of the Revised Code of Delaware, 1935, as amended, be and the same is hereby further amended by striking out and repealing all of 5631. Sec. 93. thereof and inserting and enacting in lieu thereof a new section to be known as 5631. Sec. 93.

5631. Sec. 93. Regulations Relative to School Busses:--(a) The State Board of Education, by and with the advice of the Motor Vehicle Commissioner, shall adopt and enforce regulations not inconsistent with this Chapter to govern the design and operation of all school busses used for the transportation of school children when owned and operated by any public school district or privately owned and operated under contract with the State Board of Education or any public school district in this State and such regulations shall by reference be made a part of any such contract with a school district, firm or individual. Every school district, its officers and employees, and every person employed under contract by the State Board of Education or a school district shall be subject to said regulations.

(b) Any officer or employee of any school district who violates any of said regulations or fails to include obligation to comply with said regulations in any contract executed by them on behalf of a school district shall be guilty of misconduct and subject to removal from office or employment. Any person operating a school bus under contract with the State Board of Education or a school district who fails to comply with any said regulations shall be guilty of breach of contract and such contract shall be cancelled after notice and hearing by the responsible officers of such school district or 'the State Board of Education.

(c) All busses Operated by the State Board of Education or any public school district or any firm or individual under contract with the State Board of Education or a school district for the purpose of transporting school pupils either to or from school or for any other purpose under jurisdiction of any school authority shall be covered by insurance to at least the following extent:

(1) Bodily Injury Coverage, including passenger hazard of:

(a) $5,000.00 for the injury or death of any one person, and

(b) Total coverage of either $100,000.00 or an amount equal to $5,000.00 plus $2,500.00 times the rated capacity of the bus for the injury or death of any number of persons in any one accident, and

(2) Medical Payment Coverage of $1,000.00.

Section 2. This Act shall become effective on July 1, 1951.
