AN ACT TO AMEND SECTION 4123, CHAPTER 41, TITLE 21 OF THE DELAWARE CODE RELATING TO VEHICLES FOLLOWING ANOTHER VEHICLE TOO CLOSELY.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each House thereof concurring therein):

Section 1. Amend subsection (b), Section 4123, Chapter 41, Title 21 of the Delaware Code by striking said subsection in its entirety and substituting in lieu thereof the following:

"(b) The driver of any truck or vehicle drawing another vehicle when traveling upon a roadway outside of a business or residence district, and which is following another vehicle, shall, whenever conditions permit, leave sufficient space, but not less than 300 feet, so that an overtaking vehicle may enter and occupy such space without danger, except that this shall not prevent a motor vehicle drawing another vehicle from overtaking and passing any vehicle or combination of vehicles. Whoever violates the provisions of this subsection, shall, for the first offense, be fined not less than $25.00 nor more than $200.00 or imprisoned not less than 10 nor more than 30 days or both. For each subsequent like offense within two years, he shall be fined not less than $50.00 nor more than $500.00 or imprisoned not less than 10 nor more than 80 days or both."
