AN ACT TO AMEND CHAPTER 25, TITLE 24, OF THE DELAWARE CODE RELATING TO PHARMACIST CERTIFICATE REQUIREMENT EXCEPTIONS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Three-fifths of all members elected to each House thereof concurring therein):

Section 1. Amend §2521(d), Chapter 25, Title 24, of the Delaware Code by striking the period at the end of §2521(d)(5) and substituting in lieu thereof the following:

"; or

(6) The sale of non-controlled drugs designated for veterinary use which require a prescription by a business not licensed as a pharmacy provided that:

a. The business is registered with the Board of Pharmacy.

b. The sale is authorized by a written or oral order from a veterinarian licensed in this or /mother state.

Prior to dispensing an order from an out-of-state veterinarian, the seller must confirm and document that the veterinarian is properly licensed in his State.

Oral orders must be confirmed by the veterinarian in writing no later than Seventy-two (72) hours after the seller receives the order.

c. The written order or confirmation of an oral order must be retained on the premises of the business for at least two (2) years after the original date of the order.

Section 2. Amend §2507, Chapter 25. Title 24, of the Delaware Code by adding a new subparagraph "(7)" to read as follows:

"(7) Business selling prescription drugs for veterinary use...$50."
