AN ACT TO AMEND TITLE 14 OF THE DELAWARE CODE RELATING TO LEVEL ll STUDENTS AND PROMOTION TO THE NEXT GRADE.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
Section 1. Amend §153(d)(2) of Title 14 of the Delaware Code by striking subparagraph a. in its entirety and inserting in lieu thereof the following:
"a. The student attends a summer school program and demonstrates a performance of Below the Standard, Level II or above on the state reading assessment prior to the commencement of the next school year: and if the student's performance is at Below the Standard, Level II, the student's parent(s) or guardian and the school district agree on an individual improvement plan in accordance with subsection §153(d)(1)a. above."
Section 2. Amend §153(d)(4) of Title 14 of the Delaware Code by striking subparagraph a. in its entirety and inserting in lieu thereof the following:
"a. The student attends a summer school program and demonstrates a performance of Below the Standard, Level II or above on the state mathematics assessment prior to the commencement of the next school year; and if the student's performance is at Below the Standard, Level II, the student's parent(s) or guardian and the school district agree on an individual improvement plan in accordance with subsection §153(d)(3)a. above."
Section 3. Amend §153(d)(5) of Title 14 of the Delaware Code by striking the phrase "(1)a. and/or (3)a." and inserting in lieu thereof the following:
"(1)a., (2)a., (3)a. and/or (4)a."
