AN ACT TO AMEND TITLE 18, CHAPTER 5, DELAWARE CODE RELATING TO CONFORMANCE WITH THE PROVISIONS OF TITLE V OF THE GRAMM LEACH BLILEY ACT OF 1999.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
Section 1. Amend Chapter 5, Title 18, Delaware Code to add new §535 as follows:
"§535. Non-disclosure of Non-Public Personal Information; Adoption of Regulations.
No person regulated pursuant to this Title shall disclose any non-public personal information contrary to the provisions of Title V of the Gramm Leach Bliley Act of 1999 (Public Law 106-002). The Commissioner may adopt rules and regulations necessary to carry out this section. Such rules and regulations shall be consistent with the provisions of Title V of the Gramm Leach Bliley Act of 1999. Nothing in this section shall be construed to create a private cause of action.”
