AN ACT TO AMEND CHAPTER 28, TITLE 24 OF THE DELAWARE CODE TO PERMIT QUALIFIED ENGINEERS TO TESTIFY AS EXPERTS IN THE DELAWARE COURTS.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
Section 1. Amend Chapter 28, Title 24 of the Delaware Code, by inserting a new § 2802A to read as follows:
Ҥ 2802A. Exemption for expert testimony.
Nothing in § 2802 of this Chapter shall be construed as prohibiting an otherwise qualified engineer, duly licensed under the laws of a state other than Delaware, from offering expert testimony in any action or proceeding in the courts of this State, consistent with the requirements of Delaware Uniform Rule of Evidence 702.”.
