SENATE AMENDMENT NO. 1
AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO MOTOR VEHICLES.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
Section 1. Amend §2710(e) of Title 21 of the Delaware Code by inserting “, Division of Family Services case worker” before “or court ordered custodian”.
Section 2. Amend §2710(e)(1) of Title 21 of the Delaware Code by inserting “ Division of Family Services case worker” after “guardian,”.
Section 3. Amend §2710(e)(2)c. of Title 21 of the Delaware Code by inserting “Division of Family Services case worker” after “Guardian,”.
Section 4. Amend §2710(e)(3) of Title 21 of the Delaware Code by inserting “Division of Family Services case worker” after the first instance of “guardian,” and inserting “Division of Family Services case worker” after the second instance of “guardian,”.
Section 5. Amend §2710(k)(1), Title 21, Delaware Code by inserting between “not licensed to operate a motor vehicle” and “, the holder of” as they appear therein the following:
“or the permit holder is in the custody of the Department of Services for Children, Youth and their Families”.
Section 6. Amend §6104(a) of Title 21 of the Delaware Code by inserting “except that case workers of the Division of Family Services, acting in accordance with §2710 of this Title, and on behalf of a child in the custody of the Department of Services for Children, Youth and their Families, shall be exempted from such liability” after “minor’s negligence”.
