HOUSE AMENDMENT NO. 1

TO

HOUSE BILL NO. 182

AMEND House Bill No. 182 on line 45 by deleting “ 5 ” as it appears thereon and inserting in lieu thereof “ 3 ”.

FURTHER AMEND House Bill No. 182 on line 56 by deleting “ class A ” as it appears thereon and inserting in lieu thereof “ class B ”.

FURTHER AMEND House Bill No. 182 by deleing line 60 in its entirety and inserting in lieu thereof the following:

“ (b) Child abuse in the first degree is a class B felony. A person convicted under subsection (a) of this section must receive a minimum sentence of 5 years at Level V. ”

FURTHER AMEND House Bill No. 182 at lines 63 and 78 by deleting “ class B ” and inserting in lieu thereof “ class C ”.

SYNOPSIS

This amendment reduces the mandatory sentence of 5 years imprisonment to 3 years for certain aggravated forms of child abuse in the second degree. It also reduces child abuse in the first degree to a class B felony rather than class A, but imposes a mandatory 5 year sentence. Finally, the new offense of child torture is reduced from a class B to a class C felony.
