HOUSE AMENDMENT NO. 1

TO

HOUSE BILL NO. 291

AMEND House Bill No. 291 on Line 11 by inserting after “reporting period.” the following:

A person’s primary employer and job title must be kept of record by the Department, but this information is not a public record under Chapter 100 of Title 29. ”.

FURTHER AMEND House Bill No. 291 on Line 31 by deleting “ pay ” and inserting in lieu thereof “ return ”.

FURTHER AMEND House Bill No. 291 on Lines 31 and 32 by deleting “ State Treasurer for deposit in the General Fund. ” and inserting in lieu thereof “ donor. ”.

SYNOPSIS

This Amendment requires the Department of Elections to keep a record of donors’ employers and their job title but this information will not be considered a public record under FOIA. This Amendment also requires a reporting party who has knowingly accepted an unlawful contribution to return it to the donor rather than pay it to the State Treasurer for deposit in the General Fund.
