HOUSE AMENDMENT NO. 1

TO

HOUSE BILL NO. 317

AMEND House Bill No. 317 on line 5 by deleting “ consistent with ” as it appears thereon and inserting in lieu thereof “ within the limits of annual ”.

FURTHER AMEND House Bill No. 317 by inserting after line 13 and before line 14 the following:

(d) Should the pool of applicants for coverage under this section exceed the annual appropriation therefor, the Department of Health and Social Services may maintain a waiting list for coverage under this section.

FURTHER AMEND House Bill No. 317 by inserting after line 14 the following:

Section 4. The total amount of benefits to be made available for the program authorized by § 530 of Title 31 shall not exceed $1,500,000 for FY2023, $2,500,000 for FY2024, or $3,275,000 for FY2025.  The Department shall develop necessary rules or regulations, including those relating to maintaining a waiting list, to ensure the fiscal year expenditure for this program does not exceed the amount set forth herein.

SYNOPSIS

This amendment provides that the medical coverage for children who would be eligible under this section will be provided only within the limit of the appropriation made for the program in the annual appropriations act, or any supplement thereto. Should the number of applicants exceed the appropriation, the Department is authorized to maintain a waiting list.

This amendment also adds a section that limits the expenditure for this program to $1.5 million in FY2023, $2.5 million in FY2024, and $3.275 million in FY2025 and authorizes the Department to develop rules and regulations necessary to stay within the cap.
