HOUSE AMENDMENT NO. 1

TO

HOUSE BILL NO. 423

AMEND House Bill No. 423 by deleting lines 33 and 34 in their entirety and inserting in lieu thereof the following:

federal law and the law of this State, including under §§ 1448A and 1448B of this title, that occur within this State. ”.

FURTHER AMEND House Bill No. 423 by deleting lines 37 in its entirety and inserting in lieu thereof the following:

from FFLs for background checks required under subsection (b) of this section. The SBI may establish another electronic means to respond to inquiries from FFLs for background checks required under subsection (b) of this section in addition to a toll-free telephone number. ”.

FURTHER AMEND House Bill No. 423 on line 48 by removing “ Superior Court as it appears therein .

FURTHER AMEND House Bill No. 423 on line 51 by removing “ or the Superior Court ” as it appears therein.

FURTHER AMEND House Bill No. 423 on line 52 by removing “ or ” as it appears after “ FFL ”.

FURTHER AMEND House Bill No. 423 on line 53 by removing “ or the Superior Court ” as it appears therein.

FURTHER AMEND House Bill No. 423 on line 55 by removing “ or the Superior Court ” as it appears therein.

FURTHER AMEND House Bill No. 423 on line 56 by removing “ or the Superior Court ” as it appears therein.

FURTHER AMEND House Bill No. 423 on line 57 by removing “ or Superior Court ” as it appears therein.

FURTHER AMEND House Bill No. 423 by deleting lines 60 through 62 in their entirety and inserting in lieu thereof the following:

(2) That the FFL may proceed with the sale, transfer, or delivery of the firearm. SBI shall provide the FFL with a unique approval number. ”.

FURTHER AMEND House Bill No. 423 by deleting line 102 in its entirety and inserting in lieu thereof and redesignating accordingly:

(e) If the SBI upholds it denial, the individual may appeal the decision to the Superior Court on the record. ”.

FURTHER AMEND House Bill No. 423 on line 108 by deleting “ (2) ” as it appears therein and inserting in lieu thereof “ (3 )”.

FURTHER AMEND House Bill No. 423 by deleting lines 110 through 124 in their entirety and redesignating accordingly.

SYNOPSIS

The amendment removes Section 2 from House Bill No. 423 which requires the Firearms Transaction Approval Program to conduct the background checks required for applications for a license to carry concealed deadly weapons. As such, all references to those specific background checks and inquiries by the Superior Court for such background checks have been deleted by this amendment. In addition, this amendment conforms the appeal process from a denial by SBI to the appeal process in the Relief from Disabilities Program which is on the record. This amendment also permits the SBI to establish another electronic means for FFLs to make inquiries of the SBI in addition to a toll free number. Finally, this amendment makes some minor technical corrections.
