DELAWARE STATE SENATE

SENATE AMENDMENT NO. 1

TO

HOUSE BILL NO. 2

AMEND House Bill No. 2, as amended, by deleting lines 4 through 5 of House Amendment No. 2 to House Bill No. 2 in their entirety and inserting in lieu thereof the following:

“ h. 2 members of the House of Representatives, 1 from the majority caucus and 1 from the minority caucus, appointed by the Speaker of the House of Representatives.

i. 2 members of the Senate, 1 from the majority caucus and 1 from the minority caucus, appointed by the President Pro Tempore of the Senate. ”.

FURTHER AMEND House Bill No. 2, as amended, on line 335 by inserting “ with no more than 2 members being registered with the same political party, ” after “ County, ” therein.

FURTHER AMEND House Bill No. 2, as amended, by deleting line 1034 in its entirety and inserting in lieu thereof “ legal representation, to present witnesses, and to request production of relevant documents. ”.

SYNOPSIS

This Amendment does all of the following:

(1) Provides for political balance on the Delaware Marijuana Control Act Oversight Committee and the Appeals Commission.

(2) Permits an individual subject to a fine, license suspension, or license revocation to request documents relevant to the regulatory action issued by the Commissioner.
