HOUSE AMENDMENT NO. 1

TO

HOUSE BILL NO. 105

AMEND House Bill No. 105 after line 17 and before line 18 by inserting the following:

c. The date the physician will discontinue services. ”.

FURTHER AMEND House Bill No. 105 after line 24 and before line 25 by inserting the following:

(5) When a physician is closing a medical practice and patient medical records will no longer be available at the physician’s place of business, the physician shall provide to the Board of Medical Licensure and Discipline notice of how former patients may obtain medical records. ”.

FURTHER AMEND House Bill No. 105 after line 38 by inserting the following:

(4) The personal representative of the person’s estate shall provide the Board of Medical Licensure and Discipline notice of how former patients may obtain medical records.

Section 2. This Act takes effect 6 months after its enactment into law.”.

SYNOPSIS

This Amendment to House Bill 105 requires that physicians provide the Board of Medical Licensure and Discipline notice of how patients may obtain their old medical records when a physician's medical practice closes or the physician dies. It also clarifies that when a physician notifies a patient that the patient-physician relationship will be discontinued, the notice shall include the date the physician services will be discontinued.

Finally, this Amendment makes this Act effective 6 months after its enactment.
