AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO ELECTRIC VEHICLES.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend Chapter 80, Title 29 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 8064. Residential electric vehicle supply equipment incentives.

(a) As used in this section:

(1) “Department” means the Delaware Department of Natural Resources and Environmental Control.

(2) “Electric vehicle” means as defined in § 8062 of this chapter.

(3) “Electric vehicle supply equipment” or “EVSE” means as defined in § 8062 of this chapter.

(b) No later than December 31, 2023, the Department, in consultation with the Department of Transportation, shall conduct and publish an assessment of existing EVSE including identification of gaps in EVSE availability and strategies to deploy EVSE. The report shall be updated every three years until September 30, 2032.

(c) The Department shall facilitate and coordinate incentive programs that will increase EVSE availability at Delaware residences. Such programs shall have an initial focus on single-family homes that lack access to designated off-street parking and multi-family dwellings, including apartments and condominiums.

(d) The Department shall utilize funds allocated to the Department under § 6046 of Title 7 to develop and administer incentive programs for EVSE in geographic locations or end-uses where gaps are identified in the report required under subsection (b) of this section and to support other programs established under subsection (c) of this section.

Section 2. This Act takes effect following its enactment into law.

Section 3. Section 1 of this Act shall be repealed 6 months after the Department of Natural Resources and Environmental Control notifies the Registrar of Regulations, the Chief Clerk of the House of Representatives, and the Secretary of the Senate that the available funds to support the programs established by Section 1 will be exhausted within the following year.

SYNOPSIS

This Act directs DNREC, in consultation with DOT, to publish an assement of the availability of residential charging stations for electric vehicles, which shall include strategies to deploy additional charging stations in high-need areas. This Act further directs DNREC to develop incentive program that will improve the electric vehicle charging infrastructure based on gaps identified in the report, with a focus on single-family homes without access to designated off-street parking and multi-family dwellings.
