HOUSE AMENDMENT NO. 1

TO

HOUSE BILL NO. 99

AMEND House Bill No. 99 by deleting lines 29 through 30 in their entirety and inserting in lieu thereof the following:

“WHEREAS, State governmental bodies have a role in ensuring inclusive, coordinated, and transparent progress on the State’s climate goals, while taking into consideration the need to balance impacts to the State’s economy, labor force, energy costs, and utility infrastructure; and”.

FURTHER AMEND House Bill No. 99 by deleting lines 142 through 144 in their entirety and inserting in lieu thereof the following:

(g) The Department shall adopt the criteria required by subsection (f) of this section, and any rules or regulations necessary for implementing the provisions of subsection (f) of this section, not later than 18 months prior to the effective date of any new rules or regulations requiring emissions reductions from stationary sources to achieve the greenhouse gas emission reductions set forth in § 10003(a) and (b). Notwithstanding the foregoing, regulations promulgated pursuant to Chapter 60, Subchapter II-A of Title 7, and Chapter 70 of Title 7, which implement pre-existing offset programs, and regulations promulgated to meet federal requirements are excluded from the requirements of subsection (f) and (g) of this section. ”.

FURTHER AMEND House Bill No. 99 on line 167 by deleting “ Scientific Committee on Climate Scenarios ” as it appears therein and inserting in lieu thereof: “ Technical Climate Advisors ”.

FURTHER AMEND House Bill No. 99 by deleting lines 183 through 185 in their entirety and inserting in lieu thereof the following:

(4) The Department’s recommendations for legislative, regulatory, and policy changes necessary for the State to meet its greenhouse gas emissions reduction targets, on topics including renewable energy, energy efficiency, transportation, industrial pollutants, offsets, and land use. ”.

FURTHER AMEND House Bill No. 99 on line 189 by deleting “ Scientific Committee on Climate Scenarios ” as it appears therein and inserting in lieu thereof: “ Technical Climate Advisors ”.

FURTHER AMEND House Bill No. 99 on lines 211 and 212 by deleting “ Scientific Committee on Climate Scenarios ” as it appears therein and inserting in lieu thereof: “ Technical Climate Advisors ”.

FURTHER AMEND House Bill No. 99 on line 224 by inserting after “ Council ” and before the period therein the following: “ , and the chairs of the Natural Resources and Agriculture Committees of the House of Representatives and the chairs of the Environment, Energy and Transportation and Agriculture Committees of the Senate ”.

FURTHER AMEND House Bill No. 99 on line 225 by deleting “ Scientific Committee on Climate Scenarios ” as it appears therein and inserting in lieu thereof: “ Technical Climate Advisors ”.

FURTHER AMEND House Bill No. 99 by deleting line 226 through 227 in their entirety and inserting in lieu thereof: “ Technical Climate Advisors shall serve in an advisory capacity to the Department. The number and persons who shall serve as Technical Climate Advisors shall be determined by the Secretary and may, at the ”.

FURTHER AMEND House Bill No. 99 on line 227 by deleting “ Scientific Committee ” as it appears therein and inserting in lieu thereof: “ Technical Climate Advisors ”.

FURTHER AMEND House Bill No. 99 on line 229 by deleting “ Scientific Committee on Climate Scenarios ” as it appears therein and inserting in lieu thereof: “ Technical Climate Advisors ”.

FURTHER AMEND House Bill No. 99 on line 230 by deleting “ Scientific Committee on Climate Scenarios ” as it appears therein and inserting in lieu thereof: “ Technical Climate Advisors ”.

FURTHER AMEND House Bill No. 99 on line 233 by deleting “ Scientific Committee on Climate Scenarios ” as it appears therein and inserting in lieu thereof: “ Technical Climate Advisors ”.

FURTHER AMEND House Bill No. 99 on line 236 by inserting after “ public. ” the following: “ The list of the Technical Climate Advisors shall be publicly posted online and maintained by the Department. ”.

FURTHER AMEND House Bill No. 99 on line 271 by inserting after “ provide ” and before “ a Climate Action Plan ” the following: “ to the General Assembly by providing it to the Chief Clerk of the House of Representatives, the Secretary of the Senate, the Director and the Librarian of the Division of Research of Legislative Council, the Chairs of the Natural Resources and Agriculture Committees of the House of Representatives and the Chairs of the Environment, Energy and Transportation and Agriculture Committees of the Senate ”.

FURTHER AMEND House Bill No. 99 on line 273 by inserting “ in the same manner ” before “ every”.

SYNOPSIS

This Amendment does all of the following: (1) Adjusts a “Whereas” clause for additional considerations to meet the State's climate goals; (2) Adjusts the timing of when DNREC would promulgate offset regulations; (3) Renames the Scientific Committee on Climate Scenarios to the Technical Climate Advisors; (4) Adjusts the list of recommendations by the Department in the Climate Action Plan to include offsets; (5) Requires that the names of the individuals who are Technical Climate Advisors be publicly posted at all times; (6) Adjusts to whom the Climate Action Plan and Climate Action Plan implementation reports are to be sent.
