TO

HOUSE BILL NO. 157

AMEND House Bill No. 157 on line 20 by striking “ The Department ” as it appears thereon and substituting in lieu thereof, “ For any item seized for violation of § 2307(a)(4), the Department ”.

SYNOPSIS

This amendment clarifies that the ability of a pawnbroker, secondhand dealer, or scrap metal processor to reclaim seized items by providing proof of ownership applies only to an item which remains sealed, unopened in its original packaging, or in its original unused condition. Under HB157 pawnbrokers, secondhand dealers, or scrap metal processors may not deal in retailer gift cards regardless of whether there is a receipt or other proof of ownership provided.
