HOUSE AMENDMENT NO. 2
TO
HOUSE SUBSTITUTE NO. 2
FOR
HOUSE BILL NO. 142
AMEND House Substitute No. 2 for House Bill No. 142 by inserting after line 6 the following:
“ ( ) “Protected Class” includes race, religion, color, disability, sexual orientation, sex, age, gender identity, national origin, and ancestry of a person. ”.
FURTHER AMEND House Substitute No. 2 for House Bill No. 142 on lines 10 and 11 by deleting the phrase “ Sexual Orientation, Sex, Gender, Gender Identity, or Sex Assigned at Birth ” and inserting in lieu thereof the phrase “ Status as a Member of a Protected Class ”.
FURTHER AMEND House Substitute No. 2 for House Bill No. 142 on lines 14 and 15 by deleting the phrase “ sexual orientation, sex, gender, gender identity, or sex assigned at birth ” and inserting in lieu thereof the following phrase “ status as a member of a Protected Class ”.
FURTHER AMEND House Substitute No. 2 for House Bill No. 142 on lines 19 and 20 by deleting the phrase “ sexual orientation, sex, gender, gender identity, or sex assigned at birth ” and inserting in lieu thereof the following phrase “ status as a member of a Protected Class ”.
FURTHER AMEND House Substitute No. 2 for House Bill No. 142 on line 27 by deleting the phrase “ sexual orientation, sex, gender, gender identity, or sex assigned at birth ” and inserting in lieu thereof the following phrase “ status as a member of a Protected Class ”.
SYNOPSIS
This amendment provides that a defendant is not justified in using force against another based on their actual or perceived status as a member of a protected class. This amendment also clarifies the definition of "protected class" when used in the Criminal Code.
