AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO NOTARIES PUBLIC.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 4332, Title 29 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 4332. Journal of a notary public [Effective Aug. 1, 2023].

(a) A Except as provided under subsection (h) of this section, a notary public shall maintain a journal in which the notary public chronicles all notarial acts that the notary public performs. The notary public shall retain the journal for 10 years after the performance of the last notarial act chronicled in the journal.

(h) This section does not apply to a notary public employed by, and working under the direct supervision of, an attorney licensed to practice law in this State.

Section 2. This Act takes effect on August 1, 2023.

SYNOPSIS

This Act exempts a notary public employed by, and working under the direct supervision of, an attorney licensed to practice law in this State from the requirement to keep a journal of all notarial acts performed by the notary public.
