SENATE AMENDMENT NO. 1

TO

SENATE BILL NO. 216

AMEND Senate Bill No. 216 on lines 38 through 40 by deleting “ However, a penalty for a health and safety violation may not exceed $2,500 per day beyond the initial day. A penalty for a nonhealth and safety violation may not exceed $1,250 per day beyond the initial day. ” and substituting in lieu thereof the following:

“ However, a penalty for a health and safety violation may not exceed $5,000 per day beyond the initial day. A penalty for a nonhealth and safety violation may not exceed $2,500 per day beyond the initial day. ”.

SYNOPSIS

This amendment restores the language in the existing Delaware Code, at lines 38 to 40 of the bill, about civil penalties for continuing violations and increases the civil penalties in the existing Delaware Code for continuing violations.
