HOUSE AMENDMENT NO. 2

TO

HOUSE BILL NO. 45

AMEND House Bill No. 45 by inserting after line 3 and before line 4 the following:

“(b) The Attorney General shall appoint a Deputy Attorney General third-party hearing officer to act as the administrative hearing officer to adjudicate charges brought by the Director of Consumer Protection against any person. Such hearing officer shall be a Deputy Attorney General third-party hearing officer who is not assigned to the Fraud and Consumer Protection Division.”

SYNOPSIS

This Amendment removes the ability of the Attorney General to appoint a Deputy Attorney General to act as the administrative hearing officer to adjudicate charges brought by the Director of Consumer Protection and instead requires the Attorney General to appoint a third party hearing officer to act as the administrative hearing officer to avoid conflicts of interest.
