SENATE BILL NO. 76

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO STATE PROCUREMENT.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 6962(c), Title 29 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

(12) All contractors and subcontractors, which employ 6 or more employees, are required, independently or through agreement with other organizations, to provide craft training for journeyman and apprentice levels through a bona fide program approved by and registered with the State of Delaware or the United States Department of Labor for any project in which workers shall be paid the prevailing wage under § 6960 of this title.

a. The requirement to provide a craft training program as set forth herein shall be waived for any project, if none of the contractors or subcontractors bidding on the project is required to have such a program.

b. For any project under $250,000 in the aggregate, contractors shall be exempt from the craft training program requirement set forth herein.

c. For any project under $100,000 in the aggregate, subcontractors shall be exempt from the craft training program requirement set forth herein.

d. The Department of Labor shall promulgate regulations identifying those crafts which shall be subject to the craft training requirement set forth herein. Those crafts may include Carpentry, Plumbing, Pipe Welding. Ironworking, Electrical, Sheet Metal, Pipefitting, Masonry, HVAC, Millwrights, Heavy Equipment Operator, Construction Laborer, Machinist, and Sprinkler Fitters.

e. Federal highway projects are exempt from the craft training requirement set forth herein.

SYNOPSIS

This bill sets the standards by which certain contractors and subcontractors are required, independently or through agreement with other organizations, to provide craft training for journeyman and apprentice levels through a bona fide program approved by and registered with the State of Delaware or the United States Department of Labor for projects in which workers shall be paid the prevailing wage under § 6960 of Title 29.
